Lumanity SMS Privacy Policy
By “Opting In” to or using a “Text Message Service” (as defined below) from Lumanity or its Affiliates, you accept these Terms & Conditions.
This agreement is between you and Lumanity or one of its Affiliates. All references to “Lumanity,” “we,” “our,” or “us” refer to Lumanity and its Affiliates.
Definitions
“Opting In,” “Opt In,” and “Opt-In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
“Text Message Service” includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).
Consenting To Text Messaging
By consenting to receive text messages from us, you agreed to these Text Messaging Terms and Conditions, as well as our Privacy Policy, incorporated herein by reference.
E-Sign Disclosure
By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.
Lumanity Text Message Service Privacy Policy
We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn’t limited to, sharing information with platform providers, phone companies, clients on whose behalf we carry out SMS communications and other vendors who assist us in the delivery of mobile messages.
Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Nonetheless, we reserve the right always to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn’t intended to modify our general Privacy Policy, incorporated by reference above, which may govern the relationship between you and us in other contexts.
Costs Of Text Messages
We do not charge you for the messages you send and receive via this text message service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.
Frequency Of Text Messages
This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).
Opting Out Of Text Messages
If you no longer want to receive text messages, you may reply to any text message with ’STOP’. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.

Lumanity SMS Terms and Conditions

These SMS Terms and Conditions (“Terms”) govern your receipt of text messages sent by Lumanity or its Affiliates (“we,” “us,” or “Company”) via Microsoft Teams and/or Azure Communication Services. By providing your mobile phone number and opting in, you agree to these Terms, the Microsoft Services Agreement, and the Azure Communication Services SMS Messaging Terms.
1. Definitions
SMS: Short Message Service, commonly known as text messaging.
User: Any individual who opts in to receive SMS from the Company.
Microsoft Services Agreement: The standard terms that govern your use of Microsoft services.
Azure Communication Services SMS Messaging Terms: The specific terms for SMS sending via Azure.
2. Consent and Opt-In
Lumanity will only contact you where you have consented to receiving SMS text messages. This consent may have been given to Lumanity directly or to one of our clients on whose behalf we contact you.
Where you are asked to provide consent via SMS, you must explicitly opt in to receive SMS by entering your mobile number in our Teams form or replying “YES” when prompted.
By opting in, you confirm you are the mobile number’s subscriber or have authorisation to provide it.
3. Types of Messages
We may send:
- Service notifications (only where required, e.g. account alerts, system updates).
- Transactional messages (messages from Lumanity or on behalf of clients communicating with you about a service or product, appointment reminders).
4. Message Frequency
Message frequency may vary but will be limited to a reasonable number in accordance with what is reasonably necessary to facilitate the service being provided.
5. Message and Data Rates
Standard messaging rates and data charges from your carrier may apply.
6. How to Opt-Out
To stop all SMS communications, reply with “STOP.”
For help or more information, reply “HELP”.
After you send “STOP,” we will send one confirmation SMS. No further messages will follow, except as required by law.
7. Privacy and Data Protection
Your personal data will be handled in accordance with our Privacy Policy and Microsoft’s privacy practices. For further information on our data protection practices, please see Lumanity’s Privacy Policy and our SMS Privacy Policy.
8. Compliance with Microsoft Policies
All SMS communications will comply with the Microsoft Services Agreement, Microsoft Teams Terms of Use, Azure Communication Services SMS Messaging Terms, and Microsoft Acceptable Use Policy.
We reserve the right to suspend SMS if Microsoft notifies us of any policy violation.
9. Disclaimer of Warranties
We provide the SMS service “as is” and “as available” without warranty of any kind.
We do not guarantee delivery, timeliness, or error-free transmission.
10. Limitation of Liability
To the maximum extent permitted by law, the Company and Microsoft shall not be liable for any indirect, incidental, or consequential damages arising from SMS transmission or usage.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its Affiliates, and Microsoft from any claims, losses, or damages arising from your misuse of the SMS service or violation of these Terms.
12. Changes to Terms
We may update these Terms at any time.
We will notify you of material changes via SMS or within Microsoft Teams.
Continued receipt of SMS after notice constitutes acceptance of the new Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts in London.
By opting in, you acknowledge that you have read and agree to these Terms.
