Most sponsors recognize that 505(b)(2) can accelerate development, but fewer appreciate how early the strategy can go wrong. The wrong reference listed drug (RLD), an underestimated bridging package, or a poorly timed patent certification can erase the pathway’s advantages before the first pivotal study reads out.

When executed well, the 505(b)(2) pathway offers a legitimate accelerator for drug modifications: reformulations, new strengths, alternative routes of administration, new indications, and fixed-dose combinations.
